5. Acceptable Use
Your use of the Platform is subject to our Acceptable Use Policy, which forms part of these Terms. You must not use the Platform for any unlawful purpose or in any way that could damage, disable, or impair the Service.
6. Intellectual Property
All content, features, and functionality of the Platform — including but not limited to software, text, graphics, logos, and design — are owned by or licensed to us and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Platform for its intended purpose.
You retain ownership of any data you upload to the Platform. By uploading data, you grant us a licence to process that data as necessary to provide the Service.

The Platform is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Platform will be uninterrupted, secure, or error-free, or that defects will be corrected. We make no guarantees about the accuracy of any data sourced from third-party APIs including TikTok.
9. Limitation of Liability
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from your use of or inability to use the Platform.
Our total liability to you for any claims arising from or related to these Terms or the Platform shall not exceed the total fees paid by you to us in the twelve (12) months preceding the claim.
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be lawfully limited or excluded.
10. Termination
We may suspend or terminate your access to the Platform at any time, with or without notice, for any reason including breach of these Terms. Upon termination, your right to use the Platform ceases immediately.
